DIVISION
I
TRAINING PERIOD

The board of directors of the Ordre des denturologistes du Québec may, where it considers it necessary for the protection of the public, and for a denturologist to be able to practise denturology in accordance with currently recognized standards, require the denturologist to undergo refresher training where:
(
1
)
his name has been entered on the roll more than 3 years after he obtained his permit or more than 3 years after the date on which he was entitled to be issued such a permit;
(
2
)
his name is re-entered on the roll after he has neglected to enter it for more than 3 years;
(
3
)
his name is re-entered on the roll more than 3 years after being struck off;
(
4
)
he has been recommended to that effect by the professional inspection committee or the disciplinary council under sections 113 and 160 of the Professional Code (chapter C-26);
(
5
)
he has undergone training that does not comply with the objectives and content fixed by the board of directors.

The purpose of the training is to improve the competence of the denturologist undergoing it by updating his knowledge and developing the attitudes and behaviour that are essential to the practice of his profession.
The training may consist of any of the following activities:
(

)
practical training;
(
2
)
studies;
(
3
)
courses;
(
4
)
research;
(
5
)
clinical experimentation.

A training period may not be prescribed more than 6 months after the date at which a denturologist became liable to have to undergo such training.

A decision of the board of directors to prescribe a training period must specify the objectives, the duration and the content of the training.

The board of directors shall determine where and when training must take place and, where necessary, shall designate one or several supervisors.

Training may not exceed 1,000 hours or extend over 12 consecutive months.

A course required of a denturologist may be offered by the Order, a general and vocational college (CEGEP) or a university, or be prepared or given jointly by these groups.

The supervisor shall submit to the board of directors, within 15 days after completing his duties, a report with reasons in support thereof stating whether, under his supervision, the trainee denturologist acted in accordance with the objectives and the content fixed by the board of directors.

A trainee denturologist or his supervisor may be required to submit additional reports to the board of directors on the dates determined by the latter.

The supervisor shall, at the same time he submits a report to the board of directors pursuant to section 8 or 9, send a copy of the report to the trainee denturologist.

After studying each report required under section 8 or 9, the board of directors shall decide, within 40 days following the end of the training period, whether the training complies with the objectives and the content fixed.

II
LIMITATION OF PROFESSIONAL ACTIVITIES

The board of directors may, if it so considers necessary for the protection of the public, limit the trainee denturologist’s right to practise during all or part of the training period in one or several of the following ways:
(
1
)
by determining where or when he is or is not authorized to practise;
(
2
)
by determining the professional acts he is or is not authorized to perform;
(
3
)
by requiring that all or some of the professional acts he may perform be performed under the supervision of a denturologist.

A trainee denturologist must post the decision of the board of directors limiting his right to practise his professional activities so that it can be seen by the public.

The decision of the board of directors to limit the right of a denturologist to practise must be sent to his employer, if any, and to the Régie de l’assurance maladie du Québec.

DECISION OF THE BOARD OF DIRECTORS

Before deciding to prescribe training or to change the content thereof, and before limiting the right of a denturologist to practise his professional activities, the board of directors shall give the denturologist the opportunity of a hearing. For that purpose, the board of directors shall give the denturologist a notice in writing no less than 5 days before the date of the hearing.

The board of directors may proceed by default if the denturologist does not appear at the date and time set for the hearing.

A decision that prescribes training, changes the content thereof, limits the right of a denturologist to practise his professional activities or rules on the validity of a completed training period must be given in writing with the reasons therefor and served upon the trainee denturologist in accordance with the Code of Civil Procedure (chapter C-25) or by registered or certified mail.

The board of director’s decision prescribing training or limiting a trainee denturologist’s right to practise shall take effect 30 days after being served on the latter.

The board of director’s decision changing the content of the training takes effect from the date of service on the trainee denturologist.

During training, the board of directors may, upon a request of a trainee denturologist for which reasons have been given and that has been transmitted to his supervisor, reduce the duration and requirements of the training and relax any limitation of the trainee denturologist’s right to practise.

IV
MISCELLANEOUS AND FINAL

Between the meetings of the board of directors, the executive committee shall exercise the powers of the board of directors described in this Regulation.

A denturologist shall comply with the decisions of the board of directors or of the executive committee that are given in accordance with this Regulation.
